- Eligibility
To use our services or enter into any real estate contract with us, you must:
- Be at least 21 years old.
- Have the legal capacity to enter into binding agreements under applicable UAE laws.
- Provide accurate and truthful information during registration, inquiries, or contract signing.
- Client Responsibilities
As a client, you agree to:
- Provide accurate documentation (such as identification, proof of funds, tenancy documents).
- Comply with UAE real estate laws and regulations.
- Pay all applicable fees, deposits, commissions, and service charges on time.
- Maintain leased properties in good condition and report maintenance issues promptly.
- Company Responsibilities
We commit to:
- Providing services professionally, transparently, and in compliance with UAE laws.
- Maintaining confidentiality of client data (subject to legal obligations).
- Acting as an intermediary in good faith between buyers, sellers, landlords, and tenants.
- Fees, Payments, and Refunds
- Service fees, commissions, and payments will be clearly outlined in each agreement.
- All payments must be made in AED (United Arab Emirates Dirhams) unless otherwise agreed.
- Refunds are subject to the terms of the individual contract and UAE law.
- Non-payment of fees may result in suspension or termination of services.
- Property Leasing & Management Terms
- Tenants must comply with the terms of their tenancy contract, including rent payment schedules, security deposits, and usage rules.
- Landlords must ensure properties are fit for occupation and free from legal disputes.
- Maintenance requests will be handled within reasonable timeframes, depending on urgency.
- Property Sale & Purchase Terms
- All property transactions are subject to approval by the relevant authorities (e.g., Abu Dhabi Municipality, or other local entities).
- Buyers and sellers must disclose all material facts regarding the property.
- Deposits made during property sales are typically non-refundable unless stated otherwise in the agreement.
- Intellectual Property
All website content, including text, images, branding, and layouts, are the intellectual property of Nakun Properties L.L.C – S.P.C. You may not copy, distribute, or use such content without prior written consent.
- Limitation of Liability
- We act only as a service provider and intermediary. We are not liable for disputes directly between landlords and tenants or between buyers and sellers, unless explicitly stated in the contract.
- We are not responsible for delays or failures caused by events beyond our control (force majeure), including government regulations, natural disasters, or unforeseen market changes.
- Termination of Services
We reserve the right to terminate services if:
- The client breaches these Terms.
- Payments are not made as agreed.
- Misrepresentation or fraudulent activity is detected.
- Privacy & Data Protection
We respect your privacy. Any personal data collected will be handled according to our Privacy Policy, in line with UAE data protection regulations.
- Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates, and specifically applicable local authorities where the property is located (e.g., Abu Dhabi, Dubai). Any disputes shall be subject to the exclusive jurisdiction of the UAE courts.
- Amendments to Terms
We may update these Terms from time to time. Changes will be posted on our website, and your continued use of our services constitutes acceptance of such changes.
